Hope and Kindness Partnership LLC, doing business as Hope and Kindness (“Hope and Kindness,” “we,” “us,” or “our”), is a Florida limited liability company that provides a blockchain-based, data-security software-as-a-service platform (the “Service”) accessible at hopeandkindness.com (the “Website”).
This Privacy Policy describes how we collect, use, disclose, and protect personal information when you visit our Website, create an account, or use the Service. By accessing or using the Service, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Service.
This Privacy Policy is designed to comply with applicable U.S. federal and state privacy laws. As we expand internationally, we will update this Privacy Policy to reflect additional legal requirements, including the European Union General Data Protection Regulation (GDPR), the United Kingdom GDPR, and other applicable foreign data-protection laws.
1. Scope of This Privacy Policy
This Privacy Policy applies to personal information we collect through the Website and the Service. It does not apply to information collected by third parties whose websites, applications, or services may be linked to or integrated with the Service. We encourage you to review the privacy practices of any third parties before providing them with personal information.
Important note about user-uploaded content. The Service uses blockchain-based encryption to protect content that users store on the platform. Content that you upload, store, or transmit through the Service (“User Content”) is encrypted in a manner that prevents Hope and Kindness from accessing or viewing it. You retain sole ownership of and responsibility for your User Content. Because we cannot access User Content, this Privacy Policy primarily addresses account, billing, and operational information that we do collect.
2. Information We Collect
We collect the following categories of personal information directly from you:
2.1 Account Registration Information
When you create an account, we collect information you provide, which may include your name, email address, username, password (stored in hashed form), and other information necessary to establish and maintain your account.
2.2 Payment Information
Payment for the Service is processed by our third-party payment processor, Stripe, Inc. (“Stripe”). When you make a payment, you provide your payment card details and related billing information directly to Stripe. We do not collect or store full payment card numbers. We may receive limited transaction information from Stripe, such as the last four digits of your card, card brand, billing ZIP code, and transaction status, for purposes of account management, fraud prevention, and recordkeeping. Stripe’s handling of your payment information is governed by Stripe’s own privacy policy, available at stripe.com/privacy.
2.3 Communications
If you contact us for support, including to request account closure, we collect the information you provide in your communication (such as your email address and the contents of your message).
2.4 Technical and Session Information
When you access the Service, we collect limited technical information necessary to operate the Service, including session identifiers used to maintain your logged-in state. We do not use cookies for advertising, marketing, or analytics purposes.
2.5 User Content
You may upload, store, or transmit content through the Service. This content is encrypted and is not accessible to Hope and Kindness. We do not collect, review, monitor, or process the substance of your User Content.
2.6 Information We Do Not Collect
We do not collect: sensitive financial account numbers; Social Security numbers or other government-issued identification numbers; biometric data; precise geolocation data; health or medical information; or special categories of data as defined under applicable foreign law, unless you voluntarily store such information as User Content (which we cannot access).
3. How We Use Your Information
We use the personal information we collect solely for the following purposes:
We do not use your personal information for marketing or behavioral advertising. We do not sell or share your personal information with third parties for cross-context behavioral advertising or for monetary or other valuable consideration.
4. Marketing Practices
Hope and Kindness does not conduct marketing activities directed at registered users using their personal information. Any marketing or outreach we conduct is directed only at non-users for the purpose of building general awareness of the Service. We do not add registered users to marketing lists, send promotional emails to users about third-party products, or use user information for advertising targeting.
5. How We Share Your Information
We share personal information only in the limited circumstances described below:

5.2 Legal and Regulatory Disclosures
We may disclose personal information when we believe in good faith that disclosure is necessary to: (i) comply with applicable laws, regulations, court orders, subpoenas, or other legal process; (ii) respond to lawful requests from public authorities, including for national security or law enforcement purposes; (iii) enforce our terms of service or other agreements; or (iv) protect the rights, property, or safety of Hope and Kindness, our users, or others.
5.3 Business Transfers
If Hope and Kindness is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of company assets, or similar transaction, personal information may be transferred as part of that transaction. We will notify you of any such change in ownership or control of your personal information.
5.4 With Your Consent
We may share personal information with third parties when you direct us to do so or otherwise provide your consent.
6. Data Storage and Security
We store account and billing information on infrastructure provided by AWS, with servers located in Ohio, United States. We implement reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, alteration, and disclosure. These measures include encryption in transit, access controls, and secure authentication mechanisms.
User Content stored on the Service is protected by blockchain-based encryption such that Hope and Kindness does not have access to the content. You are responsible for safeguarding any credentials, keys, or other access information necessary to access your User Content. If you lose access to such credentials or keys, we may be unable to recover your User Content.
No method of transmission over the Internet or method of electronic storage is completely secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee absolute security.
In the event of a security incident affecting your personal information, we will notify you and applicable regulators as required by law, without undue delay.
7. Data Retention
We retain your account and billing information for as long as your account remains active. Following account closure, we retain your personal information for ninety (90) days, after which it is deleted from our active systems, except where longer retention is required to comply with legal obligations, resolve disputes, or enforce our agreements.
Limited information may be retained in backup systems for a reasonable additional period before being overwritten in the ordinary course of system operations. Information retained by Stripe in connection with payment transactions is governed by Stripe’s own retention practices.
Because we do not have access to your User Content, we cannot retain or delete it on your behalf. You are solely responsible for managing your User Content.
8. Children’s Privacy
The Service is not directed to, and we do not knowingly collect personal information from, children under the age of thirteen (13). If you are under 13, please do not use the Service or provide any personal information to us.
Users between the ages of thirteen (13) and seventeen (17) may use the Service only through a sub-account established and controlled by a parent or legal guardian. The parent or guardian holding the primary account is responsible for the sub-account, including reviewing and approving the minor’s use of the Service, managing account settings, and exercising any privacy rights on behalf of the minor.
If we become aware that we have collected personal information from a child under 13 without verifiable parental consent, we will promptly delete that information. If you believe we may have collected information from a child under 13, please contact us at privacy@hopeandkindness.com.
9. Your Choices and Rights
9.1 Access, Correction, and Deletion
You may request access to, correction of, or deletion of your account information by contacting us at privacy@hopeandkindness.com. We will respond to verifiable requests within the timeframes required by applicable law.
9.2 Account Closure
To close your account, please send a request by email to our support team. At this time, account closure is processed through email support; we expect to add an in-application account-closure feature in the future. Following closure, your account information will be retained for 90 days and then deleted as described in Section 7.
9.3 California Residents
If you are a California resident, you may have rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”), including the right to know what personal information we have collected, the right to delete personal information, the right to correct inaccurate personal information, and the right to opt out of the sale or sharing of personal information. We do not sell or share personal information as those terms are defined under the CCPA. To exercise your rights, please contact us at privacy@hopeandkindness.com. We will not discriminate against you for exercising your rights.
9.4 Other U.S. State Residents
Residents of other U.S. states with comprehensive privacy laws (including, for example, Virginia, Colorado, Connecticut, Utah, and Texas) may have similar rights, including rights of access, correction, deletion, and portability, as well as the right to opt out of certain processing activities. 10. International Users
The Service is currently offered in the United States, and personal information we collect is stored and processed in the United States. If you access the Service from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States, which may have data-protection laws that differ from those in your jurisdiction.
As we expand the Service to additional jurisdictions, we will update this Privacy Policy and implement additional safeguards (such as Standard Contractual Clauses and supplementary measures) as required by applicable law.
11. Third-Party Links and Services
The Website or Service may contain links to third-party websites, applications, or services that are not operated by us. This Privacy Policy does not apply to those third-party services, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third party before providing personal information.
12. Future Blockchain Architecture
The Service currently uses blockchain-based encryption technology but does not write user data to a public or private blockchain ledger. We are evaluating a future migration of certain Service components to a private blockchain. Before any such migration, we will update this Privacy Policy to describe what information, if any, would be written to a private blockchain, how access to the ledger will be controlled, and how the architecture interacts with applicable data-subject rights (including rights of correction and deletion). We will provide notice and obtain consent where required by law.
13. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email to the address associated with your account and by posting a prominent notice within the Service at least thirty (30) days before the changes take effect. The “Effective Date” at the top of this Privacy Policy indicates when it was last revised. Your continued use of the Service after the effective date of any updated Privacy Policy constitutes your acceptance of the updated terms.
